CINCINNATI It was a murder case worthy of a TV crime drama.

Rayshawn Johnson lived behind Shannon Marks in East Walnut Hills.

One morning in 1997, when Shannon's husband, Norman Marks left for work, investigators said Johnson broke in to their home and beat Shannon to death with a baseball bat.

Johnson then went on TV, portraying himself as the concerned neighbor.

"It just hurt that something like that would happen right there, right behind my house," Johnson said in 1997. "It's spooky."

Hamilton County Prosecutor Joe Deters handled the state's case.

Deters said police were watching Johnson's interview, and noticed the Air Jordan shoes he was wearing. They provided a match to footprints found in the victim's home.

"(Investigators) brought him in and ultimately, he confessed to what happened," said Deters.

sentenced to death row in 1998.

Now, 13 years later, the sequel is about to unfold.

Judge Jeffery Sutton calls the defense investigation "anemic and leaderless," for not interviewing Johnson's mother, apparently not reading Johnson's background from the Ohio Department of Human Services (referring to the Ohio Department of Job and Family Services), and not even thinking about a mitigation strategy until after Johnson was convicted.
